NXT Pro Academy – Terms and Conditions

Parties Defined:
For the purposes of this agreement, the following terms shall be defined as:

1. “The Basketball Lab”
   Refers to the parent company and owner of all affiliated brands and programs, including but not limited to NXT Pro Academy. The Basketball Lab is responsible for facility operations, brand management, program development, and the oversight of all training services offered.
2. “NXT Pro Academy” or “NXT Pro”
   A basketball development program operated under The Basketball Lab, designed to provide advanced training, mentorship, and exposure opportunities for youth and aspiring athletes. NXT Pro Academy is a brand and service offering of The Basketball Lab and functions as a specialized extension of its mission.
3. “The Facility”
   Refers to any and all locations where services are rendered under The Basketball Lab or NXT Pro Academy brands, including physical gyms, rented courts, or event-based venues used for training, camps, showcases, or competitions.
4. “Staff” or “Coaches”
   Refers to any individual working for, contracted by, or representing The Basketball Lab and/or NXT Pro Academy. This includes trainers, directors, coaches, volunteers, and administrative personnel.
5. “Participant”
   Refers to the athlete or individual enrolled in any program, training, or event offered by NXT Pro Academy or The Basketball Lab.
6. “Parent” or “Guardian”
   Refers to the legal guardian or parent of the participant, when the participant is under 18 years of age. The parent or guardian assumes responsibility for understanding and agreeing to these terms on behalf of the participant.
7. “Client”
   Refers to the person (either participant or parent/guardian) who registers for or pays for services rendered by The Basketball Lab and/or NXT Pro Academy.
8. “You” or “Your”
   Refers to the participant and/or client engaging in services offered by The Basketball Lab and NXT Pro Academy.

1. Membership and Subscription Agreement

Weekly Direct Debit Subscription:
NXT Pro Academy operates on a weekly direct debit basis.All memberships have a minimum 12-week commitment.   After the initial 12 weeks, memberships will remain active until you cancel by emailing nxtpro@thebasketballlab.net

By signing up, you authorise us to:

– Ongoing membership past the initial commitment period unless cancellation notice is provided.
– Charge your card or nominated bank account the membership fees you signed up for until the end of your commitment period,or the full amount remaining.

End of commitment cancellation: A 30-day notice is required to cancel your membership.
Early Cancellation: If you choose to cancel before completing the initial 12-week term, you must:
– Provide 30 days’ written notice sent to nxtpro@thebasketballlab.net, and
– Pay a $150 early exit fee
This fee covers costs related to onboarding, program design, and admin work, including Discord access and player tracking.

Responsibility for Terms: By joining NXT Pro Academy, you accept all terms and conditions. Whether or not you choose to read them or not.

2. Direct Debit Authorisation
   You authorise The Basketball Lab Pty Ltd to debit your nominated account weekly for the agreed membership fee until cancellation notice is provided and 30 days notice fulfilled.
3. Attendance and Refund Policy

You are responsible for the frequency that you choose to attend the sessions. There will be no full or partial refunds or reimbursements for reasons relating to not attending scheduled training sessions, irrespective of the reason.Membership includes access to exclusive online content to support development. This content is included in your membership, therefore lack of use or consumption of this content does not facilitate a valid reason for a partial or full refund or discounted rate.

4. Online Content Sharing Policy
   All online content is for paying members only. First offense for sharing content: $150 fine.
   Second offense: Immediate removal from the program. If within your commitment period, the remainder will be charged. – If outside the commitment, a 30-day notice fee applies.
5. Pause / Membership Freeze Policy
   One 2-week pause allowed per 12-week period.  Pauses extend your commitment term.
   No additional pauses without a valid doctor’s certificate. – Freezes begin once the certificate is received.
6. Program Management and Player Commitment
   We reserve the right to terminate memberships for breaches, poor behavior, or lack of effort. – Player groups may change based on skill, effort, and attitude. The purpose of this program is to foster high-performance development and does not include any complementary disciplinary or general behavioural training services.
7. Coaching and Program Delivery
   Coaches may vary.  All are Basketball Lab certified. Continued participation is expected regardless of coach assignment.  There may be times when sessions get rescheduled, or cancelled due to coaching availability, while we have back up coaches unforeseen circumstances can arise, by agreeing to the terms you accept this.  In the event of this occurring subscriptions may be paused to prevent direct debits.
8. Session Booking Policy

You must book your sessions in advance. – If you’re not booked in, you cannot attend. – No excuses will be accepted.

If you book a session and don’t show, you will be charged a $10 no show fee, this covers the loss of opportunity for other players to book and utilize these sessions.

9. Photography and Videography Consent
   You consent to the use of training photos and video for NXT Pro Academy and The Basketball Lab’s marketing and educational purposes.
10. Waiver of Liability
    You accept the risks involved in physical training. You waive all claims against The Basketball Lab Pty Ltd, The Basketball Lab, and its sta
11. Injury and Death
    You understand participation involves risk. We accept no responsibility for injury or death during training.
12. Debt Collection Policy
    Accounts overdue by 60 days will be sent to a third-party debt collector.  Full outstanding balance, including remaining commitment, will be pursued. If you’re out the initial term and haven’t provided a cancellation notice while being 60 days overdue, this will be considered a default cancellation: – Weekly charges will stop, a 30-day notice fee will be added, and debt collection will be initiated.
13. Terms Updates and Amendments
    We may amend terms at any time. You will be notified via email and have 7 business days to raise any concerns. No response will be considered full acceptance of the new terms and conditions.
14. Final Agreement
    By proceeding with payment or participation, you:
    Confirm you’ve read, understood, and accepted all terms.
    Accept full responsibility for your membership.
    Agree that failure to read the terms will not result in any leniency.
